Agreement

Introduction

By letting your dog stay with Good Dog Sitting (also referred to as WE or US), YOU agree to the following terms. This is a legal contract, so please read it carefully.

Services

WE provide dog sitting services in OUR home. WE do OUR best make sure that YOUR dog is well cared for and comfortable. WE do not warrant that OUR dogs or other dogs staying with US will get along with YOUR dog. If OUR dogs don't get along with YOUR dog, WE will attempt to contact YOU to pick YOUR dog up. If YOU can not do that, YOU accept full responsibility for any injuries (including death) to YOUR dog.

Payments

Payment for OUR services are $5 for less than 4 hours, $10 per day for any stay longer than 4 hours. These rates are per dog. All payments must be made in cash.

If YOUR dog is staying with US longer than 7 days, YOU must pay 50% of the fee when YOU drop off YOUR dog and the balance when YOU pick up YOUR dog. Payments for stays of fewer than 7 days may be made when YOU pick up YOUR dog.

While WE may allow YOU to pay in forms other than cash or delay payments for OUR services, that will be at OUR sole discretion for one stay only.

Any costs incurred by US while caring for YOUR dog will also be payable by YOU at the time that YOU pick up YOUR dog. Such costs may include (without limitation):

• Veterinary costs in case of illness, injury or death
• Special food requested by YOU
• Damages to OUR home or possessions
• Injury to any person or animal, including US or OUR dogs
• Legal costs incurred due to the above or enforcing the terms of this agreement

Privacy

For visitors to this site, OUR standard privacy policy applies and is incorporated by reference. It also applies to YOU if YOU use OUR services.

As a user of these services, YOU agree that WE may disclose the private information kept by US to any valid law enforcement agency if you violate the terms of this agreement or they make a request for the information.

As of May 25, 2015, YOU also agree that WE may post a description and photo of YOUR dog(s) on this site. This is only done for dogs that WE care for multiple times and will not include any personally identifiable information about YOU, other than the information about YOUR dog(s).

Modifications

WE may change these terms and conditions at any time by posting them here. Once posted, the changes become binding upon YOU and US unless YOUR dog is already staying with US; if YOUR dog is staying with US when WE make a change, the old version applies until YOUR dog's stay ends. Any other changes must be in writing and signed by both YOU and US.

Warranties

These services are provided AS-IS. There are no warranties with this service, including, without limitation, warranites of merchantability, fitness for a particular use, and so on.

SOME JURISDICTIONS DO NOT ALLOW LIMITING SOME WARRANTIES. IN THOSE JURISDICTIONS, THE ABOVE APPLIES AS MUCH AS POSSIBLE AND DAMAGES ARE LIMITED AS DESCRIBED BELOW. CHECK YOUR LOCAL LAWS FOR DETAILS.

Indemnification

YOU agree to hold US, OUR veterinarian and any other person involved in caring for YOUR dog harmless for any harm to YOU or YOUR dog arising from YOUR use of this service. Such harm might include, without limitation:

• Injury or death of YOUR dog
• Illnesses or parasites transmitted to YOUR dog
• Loss of YOUR dog
• Loss of or damage to possessions that YOU brought with YOUR dog (including, but not limited to, food, crates, beds, toys, leashes, etc.)
• Injury to YOU caused by OUR dogs or any other dogs staying with US
• Financial losses due to any of the above
• Incidental or consequential damages due to any of the above

Limitation of Liability

In the event that WE are held liable for any damages, those damages will be limited to the amount YOU paid to US for the dog sitting session where where the liability occurred. If that session cannot be determined, YOU agree that will be considered to be the most recent session.

Severability

Should any part of this contract be ruled invalid, YOU agree that the rest of it remains intact and binding.

Jurisdiction

This contract will be governed by the laws of the State of California, United States of America. Any legal action will take place in the County of San Benito where possible.

Entirety

This is the entire contract between YOU and US. It may only be changed as noted above.
